Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and Bigorna Labs, Lda., a company registered in Portugal ("we", "us"), governing your use of HeadshotsAI (the "Service"). By uploading a photo, completing a purchase, or otherwise using the Service, you agree to these Terms.

HeadshotsAI generates professional headshots from a single user-uploaded photo using third-party AI models. You upload one selfie, pick a style preset, and receive four watermarked previews. After purchase, you receive a download link to the high-resolution, unwatermarked versions.

By using HeadshotsAI, you confirm that:

• The uploaded photo is of yourself, or you have the explicit, documented consent of the person in the photo.
• You are at least 16 years old (or have a parent or guardian acting on your behalf).
• You will not use the Service to generate headshots intended for impersonation, identity fraud, harassment, defamation, sexual content, or any unlawful purpose.
• You will not attempt to circumvent our content safety filters or rate limits, or use the Service to reverse-engineer the underlying models.

We reserve the right to refuse generation and terminate accounts for violations.

Upon successful payment, we grant you an unrestricted, perpetual, worldwide, royalty-free commercial license to use the headshots you have purchased. You may use them on LinkedIn, your company website, press kits, advertising, print collateral, decks, social media — anywhere a stock-photo headshot would go. The license is yours to keep even though we delete the underlying files after 24 hours.

You may not redistribute the model or use a purchased headshot to present yourself as someone else.

All purchases are one-time. Prices shown at the checkout ($9 Starter, $19 Pro, $29 Ultimate) are in US dollars and final unless noted. Taxes may be added depending on your billing location.

Payments are processed via RevenueCat and Stripe. We do not see, store, or process your card details directly.

Every order ships with watermarked previews you can review before paying. You only complete a purchase once you've seen the actual output we'd be unlocking — there's no blind buy. For that reason, all sales are final and we do not issue refunds for delivered headshots.

For billing errors (duplicate charges, accidental purchase you never previewed, technical failures that prevented delivery), email support@theheadshotsai.com with your order ID and we'll make it right.

Your uploaded selfie and every generated headshot are permanently deleted within 24 hours of generation. This is automatic and applies to paid orders. We do not offer an extended storage tier. Download your pack within the 24-hour window using the link we email you.

We never use your uploaded photo or your generated headshots to train, fine-tune, or evaluate any machine learning model. Our upstream AI provider (Replicate) is also contractually prohibited from training on inputs submitted through their paid API, which is the integration we use.

You retain all rights to your original uploaded photo. We claim no ownership over it and use it only to perform the generation you requested.

Generated headshots are licensed to you upon payment under the terms in section 4.

The HeadshotsAI name, branding, website, UI, and source code are the property of Bigorna Labs, Lda. Nothing in these Terms grants you any right to use those assets except as needed to use the Service as intended.

The Service is provided on an "as is" and "as available" basis. AI-generated outputs are inherently variable; we generate four variations per style to maximise the odds that you find one you love, and we offer at least one free regeneration with every order. We do not warrant that the Service will be uninterrupted, error-free, or that every result will meet your subjective standards.

To the maximum extent permitted by applicable law, our total cumulative liability arising out of or related to your use of the Service is limited to the amount you paid us for the Service in the twelve months preceding the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, lost goodwill, or business interruption.

Nothing in these Terms limits liability that cannot be limited under applicable law (including statutory consumer rights in the EU).

You agree to indemnify and hold Bigorna Labs, Lda. and its officers, employees, and agents harmless from any claim or demand arising from your breach of these Terms, your misuse of the Service, or your violation of any third party's rights (including by uploading a photo without consent).

We may suspend or terminate your access to the Service for violations of these Terms, or for fraudulent or abusive behaviour. You may stop using the Service at any time; given the 24-hour deletion window, no further action is required to remove your data.

These Terms are governed by the laws of Portugal. Any dispute arising from these Terms or your use of the Service will be resolved before the competent courts of Lisbon, Portugal, without prejudice to mandatory consumer-protection rules in your country of residence.

We may revise these Terms as the Service evolves. When we do, we update the "Last updated" date at the top of this page. Material changes will be communicated to active customers by email.
